1. Definitions
- "Services" refers to accessible vehicle rentals, adaptive driving solutions, and medical transportation provided by Accessro
- "User," "You," or "Your" means any person accessing our services or website
- "We," "Us," or "Our" refers to Accessro operating in Winnipeg, Manitoba
- "Vehicle" includes all accessible vans, adapted vehicles, and transportation equipment
- "Content" includes all text, images, information, and materials on our website
2. Service Terms
Eligibility
- Users must be at least 18 years old to book services
- For adaptive driving services, users must possess valid driver's license
- Users must provide accurate mobility requirement information
- Medical transportation may require healthcare provider authorization
Booking and Reservations
- Bookings must be made at least 48 hours in advance when possible
- All reservations are subject to vehicle availability
- Accurate mobility requirements must be provided during booking
- Users are responsible for confirming appointment times and locations
- Changes to bookings must be communicated promptly
Service Modifications
- We reserve the right to modify service offerings and pricing
- Changes will be communicated through website updates
- Existing bookings honor original terms and pricing
- Service interruptions for maintenance will be scheduled with notice
3. User Responsibilities
Accurate Information
Users must provide:
- Truthful personal and contact information
- Precise mobility device specifications and dimensions
- Accurate medical equipment requirements if applicable
- Current insurance information for billing purposes
- Emergency contact details
Vehicle Care
For vehicle rentals, users must:
- Operate vehicles safely and according to instructions
- Maintain cleanliness during rental period
- Report any equipment malfunctions immediately
- Not modify or alter accessibility equipment
- Return vehicles in the condition received
Respectful Conduct
Users agree to:
- Treat drivers and staff with respect

- Not engage in discriminatory or harassing behavior
- Comply with all applicable traffic laws when driving
4. Prohibited Activities
Users may not:
- Use services for illegal activities or purposes
- Provide false information during booking or service
- Tamper with or disable accessibility equipment
- Use vehicles beyond their rated capacity
- Transport hazardous materials without authorization
- Allow unauthorized individuals to operate rental vehicles
- Engage in reckless or dangerous driving behavior
- Misuse medical transportation services
5. Payment Terms
Pricing and Fees
- All prices are in Canadian dollars (CAD)
- Quoted prices include applicable taxes unless otherwise stated
- Additional fees may apply for after-hours service
- Late return fees apply at hourly rate
- Damage beyond normal wear results in repair charges
Payment Methods
- Payment required at time of booking or service completion
- Accepted methods include credit cards and direct insurance billing
- Insurance billing subject to provider authorization
- Users responsible for non-covered amounts
Cancellation and Refunds
- Cancellations more than 24 hours in advance: full refund
- Cancellations within 24 hours: 50% cancellation fee
- No-shows: full charge applies
- Medical emergencies considered on case-by-case basis
- We reserve right to cancel for safety or availability reasons
6. Disclaimers and Limitations
Service Disclaimer
Services are provided "as is" without warranties of any kind. While we maintain high standards, we cannot guarantee:
- Uninterrupted or error-free service
- Specific outcomes or results from service use
- Compatibility with all mobility devices
- Availability at all times or locations
Limitation of Liability
- Our liability limited to service fees paid
- Not liable for indirect, consequential, or incidental damages
- Not responsible for personal property left in vehicles
- Not liable for delays due to circumstances beyond our control
- Insurance coverage subject to policy terms and conditions
User Assumption of Risk
Users acknowledge that transportation involves inherent risks and assume responsibility for their participation in services, subject to our duty of care and safety standards.
7. Intellectual Property
- All website content remains property of Accessro
- Limited license granted for personal, non-commercial use
- No reproduction without written permission
- Trademarks and logos are protected intellectual property
- User-submitted content licensed to us for service purposes
8. Dispute Resolution
Informal Resolution
Before pursuing formal action, users agree to contact us to attempt resolution through discussion. Most concerns can be addressed through direct communication with our customer service team.
Governing Law
- These terms governed by laws of Manitoba, Canada
- Disputes subject to jurisdiction of Manitoba courts
- Canadian federal transportation regulations apply
- Accessibility standards follow Canadian requirements
Mediation and Arbitration
If informal resolution fails, parties agree to attempt mediation before pursuing litigation. Arbitration available by mutual agreement.
9. Termination
- Either party may terminate service relationship with notice
- Immediate termination for violations of these terms
- Outstanding payments due upon termination
- Certain provisions survive termination (payment obligations, liability limitations)
10. Changes to Terms
We reserve the right to modify these Terms of Service:
- Material changes communicated via email or website notice
- Continued use after changes constitutes acceptance
- Users may discontinue service if disagreeing with changes
- Last updated date indicates most recent revision
11. General Provisions
Entire Agreement
These terms, together with our Privacy Policy, constitute the complete agreement between you and Accessro regarding service use.
Severability
If any provision deemed invalid, remaining provisions continue in effect.
No Waiver
Failure to enforce any right or provision does not constitute waiver of that right.
Assignment
Users may not assign rights or obligations under these terms. We may assign to affiliates or successors.
